Many buyers at completed estates in North Bangalore live abroad, and the process works well from overseas with the right preparation. NRI buying resale flat in Bangalore involves the same core steps as any resale, plus a few extras: payment rules, a power of attorney for signing in India, and tax deductions when the seller is also a non-resident. Below, we walk through eligibility, payments, documents, loans, and tax points, using a resale home at Misty Waters in Hebbal as an example. Tax rules change, so confirm current rates with a chartered accountant before you sign.
Non-resident Indians (NRIs) and Overseas Citizens of India (OCIs) can buy residential property in India under the foreign exchange rules, without special permission. The main exclusions are agricultural land, plantation property, and farmhouses, none of which apply to an apartment in a completed estate. There is no limit on the number of residential properties an NRI can own.
Payments must come through normal banking channels. Funds can be paid from a Non-Resident External (NRE), Non-Resident Ordinary (NRO), or Foreign Currency Non-Resident (FCNR) account, or remitted from abroad into India. Payments in foreign currency cash or through third-country accounts are not allowed. Keep bank statements and payment receipts carefully; you will need them when you sell or if you ever repatriate the proceeds, and your bank may ask for them again at that point.
A power of attorney for NRI property purchase lets a trusted person in India sign documents and attend registration on your behalf. Draft it specifically, naming the property, the actions allowed, and the limits. If you sign it abroad, have it notarised and then apostilled or attested by the Indian embassy or consulate, depending on the country. Once it reaches Karnataka, it usually needs to be stamped within a set period, typically three months, before it can be used at the sub-registrar's office. Many NRIs choose a parent, sibling, or trusted lawyer as the holder.
Some buyers prefer to fly in for registration instead, which removes the need for a power of attorney for that step.
The buying process follows the standard resale path:
Shortlist homes by phase, size, and floor, with photos, video walkthroughs, and floor plans
Verify the sale deed, occupancy certificate, Khata, encumbrance certificate, and association no-objection certificate (NOC)
Agree price and terms with the seller, then sign the sale agreement and pay the token advance
Arrange finance if needed, through an Indian bank that lends to NRIs
Register the sale deed at the sub-registrar's office, paying stamp duty and registration of roughly 7.6% for properties above Rs 45 lakh in Bengaluru
At Misty Waters, homes range from 2 BHK to 4 BHK across Phase 1 and the Vista Tower, and prices are shared on request. Our home loan guide for resale buyers covers lender checks and sample instalments.
Tax deduction at source (TDS) depends on who is selling. If the seller is resident in India and the price is Rs 50 lakh or more, the buyer deducts 1% TDS and deposits it with the tax department. Where the seller is an NRI, the rules are stricter: TDS on property purchase from NRI sellers applies at the rates set for non-residents' capital gains, plus surcharge and cess, which can be much higher than 1%. The buyer needs a Tax Deduction Account Number (TAN), must deposit the tax, file a return, and issue a certificate to the seller. A seller can apply for a lower-deduction certificate from the tax department, which buyers can rely on if it is produced in time. Always confirm the current rates and forms with a tax adviser.
Indian banks and housing finance companies lend to NRIs, typically on the basis of overseas income documents, employment proof, credit history, and sometimes a co-applicant in India. Repayments can be made from NRE or NRO accounts. Expect the lender to run its own legal and technical checks on the property.
Most NRIs never set foot in the estate until after purchase. We share recent photos and live video walkthroughs of homes, check documents, and coordinate with the seller, lender, and power of attorney holder. Once the purchase completes, many owners let the home; our guide on whether NRIs can rent out their flat covers tenancy and tax. Send an NRI enquiry to begin.
