Many non-resident Indians (NRIs) buy a home in Bangalore with plans to move back one day, and letting it out in the meantime makes sense. So, can NRI rent out flat in India without special approval? Yes: NRIs can let residential property they own, and the rent can be received in India and, within limits, sent abroad. The practical questions are tax, paperwork, and who looks after the home day to day. Below, we cover the rules, how rental income is taxed, what tenants must deduct, and how owners of homes at estates such as Misty Waters manage lettings from overseas. Tax rules change, so confirm current rates with a chartered accountant.
NRIs can let any residential property they own in India. Rent should be received into a Non-Resident Ordinary (NRO) account, since it is income earned in India. Funds in an NRO account can be repatriated abroad up to an annual limit, subject to tax being paid and the bank's documentation requirements. Owners should keep lease agreements, rent receipts, and tax records together, since banks ask for them when money is sent overseas.
NRI rental income tax works much like tax for residents, with one key difference in how it is collected. Rental income is taxed in India because the property is in India. Owners can claim a standard deduction for repairs and upkeep on the annual value, and deduct property tax paid to the municipality. Interest on a home loan for a let-out property can also be deducted, within the limits allowed.
The collection difference is TDS. A tenant paying rent to an NRI landlord must deduct tax at source at the rate set for non-residents, plus surcharge and cess, and deposit it with the tax department. This applies whether the tenant is an individual or a company. The landlord can then claim credit for that tax when filing a return in India, and may be able to claim relief in their country of residence under a double taxation avoidance agreement (DTAA).
Tenants of NRI landlords carry extra obligations. They need a Tax Deduction Account Number (TAN), must deduct TDS from each rent payment, deposit it on time, file TDS returns, and give the landlord a TDS certificate. Many tenants are unfamiliar with this, so good lease agreements spell it out clearly. Some owners obtain a lower-deduction certificate from the tax department, which reduces the TDS rate if their overall tax liability is lower.
Corporate tenants usually handle these steps routinely, which is one reason NRI owners often prefer corporate leases.
Yes. NRIs regularly let homes without visiting, relying on a trusted relative or a professional manager. A power of attorney can authorise someone in India to sign the lease, collect deposits, and handle registration of the rental agreement. Keep the power of attorney specific and limited to what is needed.
Property management services Bangalore owners use typically cover finding and screening tenants, drafting the lease, handling move-in and move-out inspections, collecting rent, arranging repairs, and paying maintenance and utility bills. Fees vary with the scope of service. For NRIs, a good manager also tracks TDS compliance by the tenant and keeps records ready for tax filing.
Inside a well-run estate, day-to-day management is simpler. At Misty Waters, the owners' association handles security, lifts, common services, and landscaping, and 100% diesel generator back-up covers homes and common areas, so a manager mainly deals with the tenant and the individual home.
A few habits make overseas letting smoother. Register the lease agreement, and keep a scanned copy with the tenant's identity documents. Collect a security deposit and record the home's condition with dated photos at move-in. Agree clearly who pays maintenance and back-up power charges. Check each quarter that the tenant has deposited TDS, since unpaid tax can delay your refunds and repatriation. Finally, plan a video walkthrough once or twice a year, so small repairs are caught early rather than at the end of a lease.
Rents at Misty Waters run from about Rs 44,000 to Rs 1.3 lakh a month, depending on size, furnishing, and floor. On the A-class developer benchmark, rental yield works out at 3.5–4% of property cost a year for a semi-furnished apartment and 4–4.5% for a furnished one, before tax and running costs.
